These terms apply to both the free tier (ComfyUI Nightly) and the paid tier (ComfyPods). Differences are set out in Article 9.
ComfyPods and ComfyUI Nightly (together, "the Service") are provided by AICU Inc. ("we", "us") and let you run ComfyUI in a browser.
ComfyUI Nightly, the free tier, is a test bench rather than a product. We use it to observe upstream ComfyUI while deciding what goes into ComfyLTS, our long-term-support package, and we open that bench to the public.
We make no warranty as to stability, availability, or the quality of anything generated.
To use the Service you must agree to all of the following.

Model terms differ from model to model. Whether output may be used commercially or redistributed depends on the model you used. We do not grant a blanket permission.
The Service is time-limited. When the allotted time elapses, your session ends without warning, including in the middle of work.
We set the allotted time and may change it.
The working environment is reset when your session ends.
None of this carries over to your next session, and you cannot retrieve it afterwards.
Save anything you need to keep, while you have it. We cannot restore it for you.
⚠️ This does not mean we retain nothing. We collect some data for service improvement and for audit. See Article 9.
The following are prohibited.
ComfyUI-Manager is not available on the Service. We disable it deliberately.
Manager can install arbitrary custom nodes, which amounts to running arbitrary code on our server. That is not acceptable in a shared environment.
Attempting to circumvent this restriction is itself a breach of this Article.
Introducing or causing the execution of arbitrary code in the environment, whether as a node, a script, a workflow, or a prompt.
Interfering with, damaging, or overloading our infrastructure, our network, or other users.
Attacking, intruding into, scanning, or bulk-sending to external systems by way of the Service.
Generating content that violates applicable law, including the law of your country of residence. This is why Article 2 asks you to declare it.
Where conduct under the preceding Article is identified, we may:
1. Suspend your use immediately 2. Suspend or delete your account 3. Preserve records 4. Report the matter to the relevant authorities
Conduct under 5.1 to 5.4 may constitute, in addition to a breach of these terms, unauthorised computer access or another violation of law. We may take legal action where we consider it necessary.
The free tier costs you nothing. In exchange, please tell us what you find.
Reports you send are recorded verbatim in a public issue tracker (GitHub Issues) and can be read by anyone.
Do not write anything you would not want made public. The report form carries the same notice.
This holds regardless of which repository the issue lands in. Treat reports as public. If you need to reach us privately, use our contact form rather than the report form.
The Service runs on shared hardware with a limited number of GPUs. When it is busy, we give precedence in this order.

If you have not sent us feedback, we may lower your login priority when the Service is busy.
This is not a penalty. The hardware is finite, so people who pay for it and people who help us verify it go first.
Paid use of ComfyPods sits outside this ordering entirely.
You will be asked to declare your age and your country of residence, because:
We may refuse service where a declaration is found to be false.
We collect the following and use it to improve the Service and to audit its use.
By using the Service you agree to the above.
We may use what we collect to:
Where we publish, the content of prompts and workflows may become public. We do not publish information that identifies you, such as your email address.
We may audit the data we collect to determine whether the law or these terms have been breached.
We do not undertake to review all generated content in advance, and we do not undertake to delete any particular data.
You may upload files. In doing so, you represent and warrant that the file does not infringe the copyright or other rights of any third party.
Where infringement comes to light, we may delete the data and suspend your use.
You are responsible for what you generate.
We welcome you posting output to social media. A note that it was made on the Service is appreciated.
These terms apply to both tiers. The differences are:

We may change or discontinue the Service, its contents, and its hours without notice. The Service exists for verification, and we do not promise continuity.
Where we change these terms, we may ask you to agree again.
The Service is provided as is. To the extent permitted by law, we accept no liability for any loss arising from use of the Service.
These terms are governed by the law of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any dispute concerning the Service.
The Japanese text is authoritative. Where this English text and the Japanese version differ, the Japanese governs.
